Photography Terms and Conditions

1. Introduction

  1. When you visit our site, engage us or place an order with Shapiro Designz and its photography services (referred to as “we/us/our”) and the Client (referred to as “you/your”), you agree to accept our Terms and Conditions and Our Privacy Policy.
  2. Your use and access to our website services and use of our services is subject to our Terms and Conditions
  3. We reserve the right to change the Terms & Conditions at any time and without notice, and your use of our services and any changes of our Terms and Conditions shall be deemed to be your acceptance of such changes. It is your responsibility to check the Terms & Conditions regularly before using our services. If you do not agree with any of our Terms and Conditions and any other changes to the Terms & Conditions you must not use our services.
  4. The terms and conditions of photography are between Shapiro Designz (“hereinafter referred to as the Photographer”) and the Client (the one who has booked or paid for a photo shoot) and this agreement is subject to the terms and conditions stipulated hereunder and their sub clauses.
  5. The Client is bound by these terms and conditions including the Client’s family, friends or attendees or other people who take part in the photo shoot by the Photographer. It is the responsibility of the Client to distribute and enlighten family members, friends or any other person attending the photo shoot about these terms and conditions.
  6. A contract is established when we accept your order and such contract is subject to our Terms and Conditions. There shall be no contract between Shapiro Designz and you if we do not accept your order. We reserve the right to accept orders and withdraw any goods or services at any time. Shapiro Designz will not be liable to you or anyone for refusing to accept your order.
  7. Confirmation of booking and payment of monies for photo shoot services signifies that the Client has read, agrees and bound by these terms and conditions unless otherwise objected to in writing prior to accepting the services of Shapiro Designz. These terms may vary on each photoshoot work.

2. Booking

  1. To secure a booking for the photo shoot the Client shall pay 50% of the photo shoot service fee as a booking fee as detailed on the quote or invoice.
  2. The other 50% of the photo shoot fee shall be paid a week before the scheduled photo shoot.
  3. Shapiro Designz reserves the right not to release photos or any product or service until all monies owed are settled by the client

3. Packages

  1. Photoshoot packages are for photographing only, in the event that the photographer needs to travel to a location for a photoshoot, the client will have to pay for the transport to the location at a rate as determined by the photographer or provide such transport to and from the location of the photographer.
  2. The decor set up for studio shoots with decor package will include a backdrop, chair, baloons which a client can choose from items stocked by Shapiro Designz. Additional decor items, lighting and props are at Shapiro Designz’s discretion.
  3. The final decor setup and style will be at Shapiro Designz’s discretion.
  4. All packages for photoshoot except wedding and church events, will allow a maximum of 2 attires to change in each photoshoot booked.

4. Cancellation/Refunds

  1. Deposits paid for a photo shoot are non refundable should the Client decide to cancel the photo shoot. 
  2. The Client can reschedule a photo shoot to another date provided that notification has been made to the Photographer at least 72 hours before the scheduled photo shoo
  3. In the event that Shapiro Designz fails to fulfil a contract which may be due to an unfortunate event such as fire, floods, destruction, theft or anything beyond the control of Shapiro Designz, rendering Shapiro Designz inability to perform in terms of the contract, the Client will be paid back all deposits paid for that contract and the Client agrees that there will be no further claims of liability against Shapiro Designz in terms of the contract

5. Products/Services

  1. The product of the photo shoot session is jpeg or png images. These can be sent on email, or transferred to a mobile phone or removable disk of the client.
  2. Photo prints, picture frames, CD writing etc. have their own prices which can be found in different packages offered by Shapiro Designz.

6. Editing of Pictures

  1. The Photographer will choose the pictures to edit. Editing and retouching process at maximum of 20 days depending on the Photographer’s schedule, amount of photos and amount of editing required.
  2. Shapiro Designz will use its discretion of professionalism in choosing the photos for editing and to manipulate or alter the images through editing or retouching up to an extent it considers best.

7. Copyright

  1. The Client grants Shapiro Designz unrestricted rights to use pictures taken by the Shapiro Designz of them, their guests, friends, children and family or any other person, and such photos may be used for self promotional purposes including but not limited to posting on Facebook pages, WhatsApp or website or in the gallery. The photos may also be used in other manners including videos etc. The Client agrees to release Shapiro Designz from any claims or liabilities relating to the use of the photographs for promotion of Shapiro Designz business interests
  2. If the Client does not want their photos or videos or that of their family members, friends, children or any other person photographed to be used in a video or to be posted or published on Facebook, WhatsApp, website or any other media, they shall notify Shapiro Designz in writing before the photo shoot.
  3. The Client agrees that all photographs and copyrights to the photographs of photos taken by Shapiro Designz remain the property of Shapiro Designz.

8. Liabilities

  1. Whilst all precautions and care is taken during the performance of the contract, Shapiro Designz shall not be held liable in the event of destruction, loss or damage to the Client or persons or products/property that may result during the photo shoot and the Client releases Shapiro Designz from any claims of liability, damages, loss or claims that may result from incidents or accidents that may arise during the photo shoot.
  2. Whilst all care is taken in the performance of the contract, Shapiro Designz shall not be responsible for damages or losses to the Clients arising from use of images taken by Shapiro Designz.
